How to report infringement
Your notice must be in writing and include:
- your physical or electronic signature, as the copyright owner or a person authorized to act for them;
- identification of the copyrighted work you believe is infringed, or a representative list if several works are involved;
- identification of the material you want removed and enough detail for us to locate it, such as a link to the content;
- your name, postal address, telephone number, and email address;
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or authorized to act on the owner’s behalf.
When we receive a complete notice, we will remove or disable access to the material and make a reasonable effort to tell the person who provided it. Incomplete notices may not be acted on.
Counter-notices
If your material was removed and you believe it was a mistake or misidentification, you may send a counter-notice to the agent above that includes:
- your physical or electronic signature;
- identification of the material that was removed and where it appeared before removal;
- a statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification;
- your name, postal address, and telephone number; and
- a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district in which Virali may be found), and that you will accept service of process from the person who sent the original notice or their agent.
We will forward a complete counter-notice to the person who sent the original notice. Unless they tell us within 10 business days that they have filed a court action to restrain the activity, we may restore the material 10 to 14 business days after receiving the counter-notice.
Repeat infringers
In appropriate circumstances, Virali will disable or terminate the accounts and workspace access of users who are repeat infringers.
False claims
Under 17 U.S.C. § 512(f), anyone who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for damages. If you are unsure whether material infringes your rights, consider consulting a lawyer before sending a notice.
